PHOTO USE & RIGHTS While photographs, floor plans, videos, and other intellectual property used to market a property are typically owned by the Vendor who created them, DE may own a sublicense to use those assets for a certain period of time, if a usage agreement is in place. If you are unsure if an agreement is in place, check with DE Marketing at marketing@elliman.com to ensure a usage agreement is in place for the photos or other intellectual property you intend to use prior to using them in any way. If you do not follow the process above, including checking with DE Marketing, DE is not responsible for any legal fees or expenses for any resulting intellectual property infringement claims, and you shall indemnify and hold harmless DE in connection with any such claims. Note that copyright and other intellectual property infringement claims are not covered by DE’s insurance, including Errors and Omissions insurance, and DE agents are required to indemnify and hold harmless DE from any claims relating to the unauthorized use of copyrighted materials.
